Introduction

Welcome to Pantrimo! These Terms of Service ("Terms") govern your access to and use of Pantrimo's website, applications, and services (collectively, the "Service"). By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service. We recommend that you read these Terms carefully and keep a copy for your reference.

Account Terms

To use Pantrimo, you must:

• Age Requirement: Be at least 13 years of age. Users between 13 and 18 must have parental or guardian consent
• Account Registration: Provide accurate, current information (email address and display name) during signup and keep your account information up to date
• Account Security: Maintain the confidentiality of your password and account credentials. You are responsible for all activities that occur under your account
• One Account: You may create only one account per person. Multiple accounts for the same individual are prohibited
• Account Responsibility: Notify us immediately of any unauthorized access to your account at support@pantrimo.com

Acceptable Use

You agree to use Pantrimo only for lawful purposes. You may NOT:

• Prohibited Content: Upload, share, or create recipes containing illegal, harmful, offensive, or inappropriate content
• Abuse: Harass, threaten, or harm other users, or attempt to gain unauthorized access to the Service or other users' accounts
• Spam: Use the Service to send unsolicited messages, advertisements, or promotional materials
• System Interference: Attempt to disrupt, damage, or interfere with the proper functioning of the Service through viruses, malware, or excessive automated requests
• Data Scraping: Use automated tools to scrape, collect, or harvest data from the Service without permission
• Consequences: Violation of these terms may result in immediate account suspension or termination
• Reporting: Report violations to abuse@pantrimo.com

Intellectual Property

Intellectual property rights are distributed as follows:

• Pantrimo Platform: The Service, including its software, design, features, and branding, is owned by Pantrimo and protected by copyright, trademark, and other intellectual property laws
• Your Content: You retain all ownership rights to recipes, meal plans, and other content you create or manually enter ("User Content")
• License to Pantrimo: By using the Service, you grant Pantrimo a worldwide, non-exclusive, royalty-free license to host, store, and display your User Content solely for the purpose of providing and improving the Service
• AI-Generated Content: Content generated by our AI features (recipes, meal plans, suggestions) is provided to you for your personal use. You may use, modify, and share AI-generated content, but Pantrimo does not claim ownership of such content
• Third-Party Content: Some recipes may reference third-party products, trademarks, or copyrighted material. You are responsible for ensuring your use of such content complies with applicable laws

AI-Generated Content

IMPORTANT DISCLAIMERS regarding AI-generated content:

• AI Limitations: Recipes and meal plans generated by our AI features are created using large language models and may contain errors, inconsistencies, or inaccuracies
• Nutritional Information: AI-estimated nutritional data is approximate and should not be relied upon for medical or dietary purposes. Always verify nutritional information independently
• Allergen Warnings: While we provide allergen detection features, AI-generated recipes may not accurately identify all allergens. Always verify ingredients if you have food allergies or sensitivities
• Dietary Restrictions: AI-generated content may not fully comply with your specific dietary requirements. Review all recipes carefully before use
• Not Medical Advice: Pantrimo is not a substitute for professional medical, nutritional, or dietary advice. Consult qualified professionals for health-related dietary decisions
• User Responsibility: You assume all responsibility and risk for following any recipe or meal plan, whether AI-generated or user-created

Limitation of Liability

To the fullest extent permitted by law:

• "As Is" Service: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement
• No Guarantee: We do not guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components
• Limited Liability: Pantrimo's total liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the amount you paid us (if any) in the twelve months before the claim arose
• Exclusion of Damages: Pantrimo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses
• Force Majeure: We are not responsible for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or infrastructure failures
• Food Safety and Recipe Risk: You expressly acknowledge and agree that:
  • Following recipes involves inherent risks including food allergies, anaphylaxis, food-borne illness, poisoning, choking, cuts, burns, and other injuries
  • AI-generated allergen detection and nutritional information may be incorrect, incomplete, or misleading
  • You assume ALL risks associated with preparing, cooking, serving, and consuming any recipe or food item suggested by the Service
  • Pantrimo shall have NO LIABILITY for any injury, illness, allergic reaction, or death resulting from use of recipes or dietary information
  • You will independently verify the safety and suitability of all ingredients and recipes before use

Indemnification

You agree to indemnify, defend, and hold harmless Pantrimo, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your User Content or any content you share through the Service; (c) your violation of these Terms; (d) your violation of any rights of another party, including intellectual property rights; or (e) any harm or injury resulting from following recipes or meal plans. This indemnification obligation survives termination of your account and these Terms.

Termination

Either you or Pantrimo may terminate your account:

• Your Right to Terminate: You may delete your account at any time through the Profile settings. Account deletion includes a 30-day grace period during which you can recover your account by logging in
• Our Right to Terminate: We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms, suspected fraud, or abuse of the Service
• Immediate Termination: We may immediately terminate accounts for serious violations, including illegal activity, harassment, or security threats
• Effect on Data: Upon termination, your access to the Service will cease. After the 30-day grace period, all your data will be permanently deleted as described in our Privacy Policy
• Survival: The following sections survive termination: Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, and any other provisions that by their nature should survive

Dispute Resolution

If a dispute arises between you and Pantrimo:

• Governing Law: These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles
• Informal Resolution: Before filing any formal claim, you agree to first contact us at legal@pantrimo.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 60 days
• Jurisdiction: Any legal action arising out of or relating to these Terms or the Service shall be filed exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts
• Time Limit: You must bring any claim related to these Terms or the Service within one (1) year from when the claim arose, or such claim is permanently barred
• Individual Basis: Claims must be brought on an individual basis. You may not participate in class actions, class arbitrations, or representative actions

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email (sent to the address specified in your account) and/or by prominently posting a notice in the application at least 30 days before the changes take effect. We will also update the "Last updated" date at the top of these Terms. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Service and delete your account.
